Cherish the Children MegaRaffle Rules
Liberty House, a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting this raffle to raise funds for ongoing charitable purposes. The Rules and Regulations of the Cherish the Children MegaRaffle are set forth below. By purchasing a raffle ticket, the purchaser agrees to be bound by these rules and regulations. Liberty House’s interpretation and application of the rules and regulations shall be final.
The Prize Drawing for the Cherish the Children MegaRaffle will be held on Saturday, May 6, 2023 starting at 6:30 pm. Tickets will not be sold online after 5:00 pm on May 5, 2023. If not sold out, tickets will be available for purchase at the live drawing from 5:00 pm - 6:00 pm on May 6 at the Salem Convention Center. Tickets may sell out before that time. The drawing for prizes may be open to the public online, and the winner does not need to be present in-person or online to win.
A maximum of 1,000 tickets will be sold. The chances of winning are based on that number. If fewer tickets are sold, the chances of winning the prizes improve. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
By entering this raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by Liberty House for publicity purposes and in lists of prize winners to be published on the Liberty House raffle website. By entering this raffle, each participant releases Liberty House, its directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold Liberty House harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of participating in the raffle or the winner’s acceptance or use of any prize.
Tickets
Tickets are $100 each, or 3-pack for $250. Only one method of payment, one name, and one mailing address are permitted per ticket pack. Only one eligible person may be entered in the raffle per ticket sold. If the name of more than one person is submitted with a ticket purchase, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner regardless of who paid for the ticket. Division of any prize by a group purchasing a ticket in common shall be to the sole responsibility of the person named as the holder of record of that ticket, should that ticket be selected as a winner.
Liberty House assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A raffle participant’s sole and exclusive remedy for Liberty House’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall Liberty House, its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
Selection of Winners
The drawing will be held on May 6, 2023 starting at 6:30pm. All drawings are open to public livestream at libertyhousecenter.org. Winners will be notified according to the contact information provided to Liberty House at the time of ticket purchase. In addition to the list of winners posted on the Liberty House website, a list of winners may be obtained from Liberty House by request. Per OAR 137-025-0290, winners do not need to be present at the time of the drawing in order to win. Additionally, prizes will need to be picked up by the winners at a location Liberty House will designate within 6 months of the prize drawing. If the prize is not picked up within 6 months, the prize will be donated back to Liberty House.
The odds of winning a prize will depend on the number of tickets sold. If all 1,000 tickets are sold the odds of winning any individual prize is 1 in 1,000. If fewer tickets are sold, the chance of winning all prizes improves. The odds to win a prize are no less than 1 in 10.
Winner is solely responsible for applicable taxes on any raffle prize won.
Liberty House will make reasonable efforts to contact prize winners using information provided on the ticket purchase form. If a prize winner does not contact Liberty House within 30 business days after the first initial contact notifying the prize winner of their winnings, then Liberty House shall give notice to such prizewinner by U.S. Postal Service certified mail, return receipt requested, at the address set forth in the information provided by the Eligible Ticket Purchaser. This notice shall state (a) the prize won, (b) a telephone number of a contact person at Liberty House, (c) the time and location where the prize(s) can be claimed, and (d) that if the prize has not been claimed within 6 months from the date of the drawing, that Liberty House will deem the prize to be donated back and Liberty House will retain the prize for use as its discretion.
Eligibility
Entrants must be 21 years or older at time of purchase to purchase a ticket. Ticket purchaser must be present in Oregon at the time of purchase. All federal, state, and local laws and regulations apply. The raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from prize winners.

Prizes can be picked up by appointment at Liberty House’s West Salem Campus, 1174 Cornucopia St. NW Ste. 120, Salem, OR 97302. Please call 971-599-5876 to schedule an appointment. If a person other than the prize winner wants to pick up a prize, Liberty House will require written approval from the person whose name is written on the ticket.
The raffle prizes are distributed “as is.” Liberty House makes no warranties of any kind, expressed or implied, concerning the use and safety of goods and services sold, including, and without limitation, the implied warranties of merchantability and fitness for a particular purpose. The prize winner bears the entire risk of the quality, performance, and safety of the donated items. Liberty House has not tested or inspected the goods and services for their quality and safety. Some of the activities offered as prizes may be considered “high risk.” The prize winner shall consider this and assume all risks upon receiving the prize and engaging in such activities. Liberty House shall not be responsible for any injuries or damages that result from the buyer’s use of the raffled items or services, or from participation in services or activities purchase.
Liberty House assumes no responsibility for loss or misplacement of certificates once the prize winner has taken possession.
Travel packages sold through the raffle contain only those elements listed in the prize description. Any changes or additions to travel will be at the winner’s expense. This condition also applies to rental cars or other transportation not included in the prize description.
Expiration dates are NOT flexible. Expiration dates have been carefully selected by the donors involved. The request of an extension beyond the expiration date could place undue burden on the donor and jeopardize future donations to the raffle. All reservations (air, rental cars, lodging, etc.) must be made within dates specified in supporting documentation and as contained in the prize package.
Once a trip is scheduled and confirmed by the prize winner, changes may not be allowed by the donors. If a donor is unable to accommodate requests to reschedule or if a requested change results in a donor not being able to honor all components of the trip, Liberty House will not refund any portion of the trip purchase.
Some trip features or amenities may have to be paid by the prize winners at the time of use. Such expenditures will not be reimbursed unless specifically listed in the prize description as qualified for reimbursement by the raffle.
If a prize winner donates a travel package won in the raffle to another charity, or it is resold to another person, prize winner assumes ALL risk. Liberty House will not be responsible for honoring any elements contained in travel packages purchased outside the raffle.
General Terms and Conditions
As a condition of and in consideration for participation in the Cherish the Children MegaRaffle, ticket purchasers release Liberty House and its raffle affiliates from any liability connected with the reproduction, adaptation, display, publication, and distribution, in any and all media, whether now known or yet to be developed, of any videos, photographs, or other images taken of the guests at the raffle drawing or any related events.
Any controversy or claim arising out of or relating to the contract, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (pursuant to its expedited procedures) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
